Terms and conditions of use of the website

Subject matter and scope of application

These terms and conditions of use govern the access to, browsing and use of the T-SOLAR website (hereinafter referred to as “the Website”), as well as the liabilities arising from the use of its content (“content” shall be understood to refer to all texts, graphics, drawings, designs, codes, software, photographs, music, videos, sounds, databases, images, expressions and information, as well as any other creation protected by national legislation and international treaties on intellectual and industrial property). Furthermore, “User” shall be understood to refer to any person who accesses, browses or uses the services and activities developed on the Website, free of charge or for valuable consideration.

Any access to or use of the Website by the User shall be deemed to imply their acceptance of the terms and conditions published at any time. Accordingly, the User is invited to carefully read these terms and conditions from time to time.

The purpose of these terms and conditions of use is not to govern any contractual aspects relating to the provision by T-SOLAR of its specific services. It merely provides the legal framework for the use of and access to the Website.

Access to and use of the website

Access to the Website by Users is open and free of charge.

Any information that the User provides through the Website (for example, in the “Contact us” section) which contains personal data will be subject to our Privacy Policy. With regard to the information provided by the User, the latter will be responsible for ensuring that any such information is true, complete and accurate.

Access to, browsing and use of the Website is the responsibility of the User. The latter therefore undertakes to diligently comply with any additional instructions given by T-SOLAR in relation to the Website and its content, and not to use the T-SOLAR service or its content in any way which is not expressly authorised by these conditions.

By accessing and using the Website, the User accepts the contents of these conditions. In particular, the User shall refrain from:

  • Using the content included on the Website for any purposes which are contrary to the law, generally accepted moral standards and good practice or public order.
  • Reproducing or copying, distributing, allowing public access by any means of public communication, transforming or modifying the content, unless authorisation has been given by the holder of the corresponding rights or this is legally permitted.
  • Using the content and, in particular, the information obtained through the Website, for advertising purposes.
  • Providing any personal information or information relating to the use of and access to the Website which is false or has been unlawfully obtained.

Rights held by T-Solar

T-SOLAR is the holder of all intellectual and industrial property rights over the Website, including the domain name and all the content available through it. Under no circumstances shall access to or browsing of the Website by the User be deemed to entail any transfer, licensing or full or partial assignment of such rights by T-SOLAR to the User, or that the User is authorised to use or exploit such rights publicly.

Deletion or manipulation of the copyright statement or any other identifying information or acknowledgement of T-SOLAR as the sole holder of the rights over the Website or the protected content contained on it shall be completely prohibited.

Furthermore, reproducing, distributing, publicly communicating, reusing, extracting, sending by mail, modifying or in any way publicly using all or part of the content included on the Website shall be strictly prohibited.

Liabilities and warranties

T-SOLAR diligently manages the Website and therefore endeavours at all times to provide complete and accurate information on all the services that it offers, keeping it up to date at all times. Nevertheless, it is possible that there may occasionally be a contradiction between the information offered on the Website and the service actually provided. The User is therefore invited to visit the Website on a regular basis.

T-SOLAR has always taken the appropriate measures, according to the state of technology at any time, to guarantee the proper working of the Website and to prevent the existence of any viruses or computer programs which could cause any damage to the Users.

However, IT security is not infallible and is exposed to certain risks as a consequence of the inevitable activity carried out by hackers and virus or malware programmers. Despite the fact that it makes every effort to avoid these types of programs and constantly updates its IT and systems security, T-SOLAR cannot therefore warrant or accept liability for any loss or damage suffered by the User as a consequence of the following:

  • Faults or interruptions in the Website service.
  • Viruses or computer programs or any elements designed for cyberattacks or to infiltrate the IT systems of the User which may have been inadvertently installed in the aforementioned systems as a result of access to the Website by the User.
  • The potential vulnerability of the Website and the security measures taken on it.

Links to other websites

The User may find links on the Website to other applications or websites managed by third parties, such as Twitter, Facebook, LinkedIn or YouTube. T-SOLAR does not have the authority to control all the information or content provided by third parties and cannot therefore accept any liability for the quality or trustworthiness thereof, or for the veracity or suitability of the content offered.

The establishment of any type of link from the Website to another third-party website or application does not imply any type of relationship, cooperation or connection between T-SOLAR and the person responsible for the website in question.

Term and amendments

T-SOLAR may amend these terms and conditions, in full or in part, and shall publish any changes in the same way as these general conditions.

Moreover, T-SOLAR shall do everything possible to guarantee the continuity of the service and the operation of the Website. Nevertheless, and insofar as permitted by the law, T-SOLAR may, at any time and without the need for notice, end, suspend or interrupt access to the Website content, without the User being able to demand any compensation, be it due to technical or maintenance difficulties.

Severability

If any of the provisions contained in these terms and conditions should be declared invalid or unenforceable, the remaining provisions shall in no way be affected by such a declaration.

Applicable law and jurisdiction

These terms and conditions shall be governed by Spanish law, notwithstanding any other regulations issued by a responsible authority.

Any disagreements between the User and T-SOLAR with regard to the validity and term of any of the provisions contained in these terms and conditions shall be settled by the courts in accordance with the rules of jurisdiction established in applicable legislation.
